Prop 65 became a law in 1986 in the state of California; officially named the Safe Drinking Water and Toxic Enforcement Act of 1986. Prop 65 requires businesses to provide warnings to all Californians if their products may contain chemicals or naturally occurring substances which the state of California has deemed to cause cancer, birth defects or other reproductive harm. This list, is updated a minimum of once a year, and now includes over 900 chemicals since its inception in 1987.

Recently, tetrahydrocannabinol (THC) and beta-Myrcene ( a terpene found in full spectrum hemp products) were added to the list. THC and beta-Myrcene are both naturally occurring in hemp products.

Why do Easy Day products sold in California have a warning label?

Prop 65 requires companies to inform the public about the presence of certain substances - even at trace levels in the products they sell or use. When a Prop 65 substance may be present in a product, the company is required to provide information to the public that the product contains or exposes the consumer to “chemicals known to the State of California to cause cancer” or “chemicals known to the State of California to cause birth defects or other reproductive harm.” Prop 65 warnings are required for chemicals that are commonly present in a larger variety of everyday products such as foods, supplements, cleaning agents , and beauty care products, as well as for other substances such as pesticides, gasoline, exhaust, and cigarette smoke, etc. Chances are you have seen these labels throughout the state.

What is considered a trace amounts of THC?

In hemp such as EDH, THC levels test at 0.3% or less and are not considered psycho-active.

When will EDH products first show Prop 65 warning statements?

EDH products will have the required Prop 65 warning statements starting January 3, 2021.

What does the Prop 65 warning say?

INGESTIBLES: WARNING: Consuming this product can expose you to chemicals including beta-myrcene, which is known to the State of California to cause cancer and Δ9-Tetrahydrocannabinol, which is known to the State of California to cause birth defects or other reproductive harm. Isnt THC “naturally occurring” in hemp?

While Prop 65 regulations address naturally occurring chemicals for foods thus exempting these companies and products from warning requirements – however as of yet hemp products are not yet classified as food under federal or California law.
